Terms of Services:

We provide services under certain conditions. By placing an order with SR Host BD, you are agreeing to these terms. Please read them carefully before placing your order. Here, you will learn how we provide services, why these conditions are in place, how to contact us, and how to obtain important information and assistance.

Time iT  reserves the right to modify or cancel these service terms at any time. If any significant changes are made, they will be announced via email or website announcements at least seven days prior. Therefore, please register with an active email or update your profile with the correct one. Invalid emails will not be accepted under any circumstances.

How to Contact Us:

If necessary, we will contact you through Mobile, WhatsApp, or e-mail.

Note: We will never ask for your password. If anyone asks for your password, immediately contact us directly through the Live Chat. If you can’t reach us via Live Chat, message us on WhatsApp at the same number (Check contact us section). Keep an eye on the website for updates.

Service of Order:

1. How do we accept orders:

After placing an order, the service fee must be paid upfront before we provide the service. Placing an order on the website does not guarantee that we will accept it. We will verify your information before accepting the order. If you provide incorrect information, your order will be canceled, and your money will be refunded.

2. Creating an Account: 

You must create an account either before or during the order process. Registration requires your Name, Address, e-mail, Phone Number, and a Password. Keep your password confidential. If you suspect someone else has logged into your account, contact us immediately.

3. Delivery Time:

All products displayed on our website can be ordered by customers if desired.

Domain: After ordering your preferred domain name, if the domain is available, it will be registered in the client’s area within 3 to 24 hours.

Hosting: After purchasing hosting, the relevant information will not be immediately sent to your registered e-mail. Please contact support to receive it.

Domain Management:

1. Email verification:

After purchasing a domain, a verification email will not be sent to you. Your domain can be managed by SR FevHost. Ensure that you provide accurate WHOIS information. SR FevHost is not responsible if incorrect information leads to your domain being suspended.

2. Third-Party Service Terms:

All gTLDs are registered and transferred through ICANN-accredited registrar companies. You must agree to ICANN’s service terms.

3. Availabilities:

Your preferred domain may not always be available. In that case, consider choosing another domain. Our site is connected with registry companies. For domain registration, transfer, and renewal, our website sends requests to the registry company. After registration, transfer, or renewal, check the WHOIS to confirm its success. If not, inform us. We are not responsible if the registration or transfer fails.

4. Domain Renewal:

An invoice will be generated 21 days before the domain renewal date. Payment must be made at least 14 days before the renewal date. If not, the domain will be canceled.

5. Renewal Details:

If possible, renew the domain at least 14 days or earlier before the renewal date. Check WHOIS to ensure the renewal was successful. If not, please inform us.

6. Domain Transfer and Ownership:

Once the domain is transferred to your account, you become the owner of the domain. The WHOIS database will reflect the details of your profile. Verify your information in WHOIS to ensure accuracy. Otherwise, someone else could take control of your domain.

7. Domain Transfer Rules:

It is recommended to complete the transfer within 15 days after expiration. For the transfer, the authorization code and domain must be unlocked. Upon transfer, one year will be added to the current term.

8. Domain Transfer Limitations:

If the current registrar company does not permit the transfer during the process of bringing the domain to us, the transfer will fail. We will not be responsible in this case. If the transfer fails, notify us, and we will refund your money. A domain cannot be transferred within two months of registration. Some domains have transfer limitations, so you may not be able to transfer repeatedly. The transfer process will start after payment is made.

9. Domain Expiration:

After three days of expiration, the domain will stop functioning, and the name servers will be changed. Therefore, make the payment before the expiration date. Some domain providers offer a grace period. If the domain expires, it will go into the grace/redemption period, during which the domain cannot be registered again. This period may last from one to three months or longer. The domain can be restored during this time by paying a penalty fee.

 If the domain expires or the grace period ends, the registrar may take the following steps:

  1. Auction the domain for sale.
  2. Release the domain for registration.
  3. Retain the domain to sell at a higher price.

If the renewal period ends and we do not receive the renewal charge, we will no longer be responsible for the domain. If you wish to recover the domain during the grace/redemption period, we can request the registry company to check for recovery options. If recovery is possible, we will assist you. However, it is not our responsibility. You will need to pay the redemption charge plus the renewal fee for recovery, but we cannot guarantee that recovery will be possible.

10. Domains We Do Not Register:

We will not register any domains that contain words like “bet,” “porn,” “xxx,” or those that imply gambling or adult content (18+). Such domains will not be eligible for a refund.

Hosting:

1. Free Domain Offer:

Some of our hosting packages offer domain registration or transfer. Please check which domain extensions are available for registration or transfer from us during the order process. The availability of free domains will be at our discretion. Only certain extensions are allowed, and this may vary based on the package. If you wish to take another domain extension, an additional fee will apply. The additional fee will depend on the extension, and the free domain charge will be deducted.

Note: To avail of the free domain, you must purchase the service for 3 years. Otherwise, the domain will remain pending and will not be registered.

   Conditions:
  1. No amount is refundable on offer packages. Therefore, if later you claim you didn’t read or notice the terms and conditions, we will not be able to assist.
  2. The domain will be activated when you order the service for 3 years. Even if the service is active earlier, the domain will remain pending until the payment for the additional 2 years is made.
  3. No refunds, not even one taka, will be given for any reason on offer packages.
  4. For the first 3 years, you only need to pay for the domain.

If you purchase the service for 1 year, and within that first year you renew for an additional 2 years, you will be able to claim the domain for free.

Alternatively, if you initially order the service for 2 years and then renew for another year within the first year, you will also be able to claim the domain for free.

And if you choose to get the service for 3 years all at once, the domain will be claimable for free right away. We give our customers time so they can pay comfortably without any issues. There is no requirement to pay for all 3 years at once.

Let’s look at this through an example:

10GB + COM – 999 BDT

The cost of our .com domain is 899 BDT. So now, if you take the service for 1 year, you do not need to pay 999 BDT + 899 BDT.

You will only pay 999 BDT for the 1 year of hosting service.

In this case, even if the hosting is activated within a short time, the domain will remain in Pending Registration status. When you renew for another 2 years (or if you took the service for 2 years, renew for 1 more year), the domain will remain in Pending Registration status until that time.

2. Hosting Service:

Hosting can be used for website hosting and email services. Activities such as batch processing, video encoding/transcoding, web crawling/spidering, archiving, and online backup systems are not allowed on our shared, cloud, or reseller hosting servers. You can only use such tools on a dedicated server after a written agreement with us. We reserve the right to take any necessary actions for the smooth performance of our system for all clients. Pornography is prohibited by Islamic law and Bangladeshi law, so it is forbidden to host any pornographic websites, images, videos, or blogs on the server.

3. Hosting Limitations:

Some packages offer “Unlimited Hosting,” which means you can use unlimited disk space or bandwidth (or both) actively within your account. However, resources like RAM, CPU, and similar components are limited on shared, cloud, or reseller hosting. Even on dedicated servers, there are limits within which you must operate.

4. Unlimited Usage:

You may use unlimited memory and bandwidth. If usage becomes excessive, server capacity will be increased. However, if a client’s usage exceeds the average significantly, extra charges may be applied.

5. Migration Service:

We offer free migration services to transfer your website or full cPanel from your previous hosting company without any data loss. We can migrate your site from anywhere, but you must provide complete access to the previous hosting service. We usually migrate websites within 2 to 72 hours but cannot guarantee an exact time. The time depends on the size and number of files in your website. In some cases, we may transfer email, DNS records, and domain names as well, though we do not guarantee that this will always be successful or without issues, as it depends on the previous hosting company.

If the package does not include free migration, an extra charge will be applied for migration. The charge will be 250 BDT or 2.5 USD per cPanel.

However, if you talk to our support team, the charge might not be applied in some cases.

6. Hosting Changes:

We reserve the right to change the hosting service on which your website is running. These changes can include server location, cloud company, or configuration updates. Upgrades will only be done when necessary. Any changes to hosting will be announced via Facebook, email, or WhatsApp. Changes may be made to provide better service or due to security threats, or if the current location/cloud company shuts down or faces issues such as war. The most common changes are to server location or cloud provider. If you have a preferred server location or cloud provider, you can let us know, but changes will not be possible if that location or provider is no longer available. We will choose a good provider or location for you (for example, moving from Microsoft Azure’s Cape Town data center to Johannesburg data center, or from AWS Bahrain to Alibaba Bahrain).

7. CDN and Bandwidth Usage:

In areas where connection costs or bandwidth prices are high (such as in the Middle East or Bangladesh), or fluctuate, we will provide you with CDN (Content Delivery Network) services. CDN services distribute traffic globally instead of from a single server, which increases website loading speed and reduces bandwidth consumption from the source. We will help you with the setup.

8. No Guarantees:

Our hosting services are equipped with high security; however, we cannot guarantee protection against attacks unless a special agreement (with extra charges) is made. If you believe your website is targeted by DDoS attacks, you should consider purchasing a third-party DDoS protection service, like Cloudflare.

9. Hosting Uptime:

We strive to provide 99.9% uptime, excluding planned or emergency server maintenance and situations beyond our control. If planned server upgrades or maintenance are expected to last more than 30 minutes, we will notify you via website announcements or email. We will attempt to resolve any server issues within 30 minutes using our skilled developers. We will also inform you of the estimated time required for resolution.

10. Backup:

We regularly take daily or weekly backups of your website, depending on the package. For optimal performance, backups are stored in a geographically similar but separate server, ensuring data safety. If you need any backup data, please contact us. We may exclude certain files, like error logs, zipped files, or cache files, that we deem non-essential for your website. Although we provide backup services, it is ultimately your responsibility to keep backups of your website. Therefore, we recommend that you take your own backups.

11. Service Interruptions:

We are not responsible for service interruptions beyond our control. However, we strive to choose server providers with excellent performance and uptime. If service is interrupted due to factors beyond our control, we will contact you as soon as possible and take steps to mitigate the impact of the interruption.

Interruptions will be announced in the client area. We are not responsible for upstream network or hardware issues, such as problems with AWS, and these will not count toward our 99.9% uptime calculation.

Reasons services might be suspended or terminated:

12. Service Upgrade:

If you wish to upgrade from your current service package to another, you must pay for one full year of the new package. In doing so, the duration of your service will extend by one year from that point onward.

We will contact you within 24 hours if we suspend or pause your service.

If the service is not reactivated, it will locally terminate at the end of the subscription period without any charges or chargebacks.

If you wish to cancel any subscription, you may contact us, and it will be canceled within 24 hours. If it falls under the money-back guarantee, you will receive a refund.

If you fail to renew your service, we may suspend the service. You are granted permission to use the service for up to 3 days, and you have up to 14 days to clear any outstanding payments. In such cases, we may charge a late fee. If payment is not made within 14 days, the service will be permanently terminated. You will receive updates via email or WhatsApp. If you pay for renewal, we will restore the service.

Service Suspension:

If your service is temporarily suspended, we can reactivate it. However, if it is permanently closed, it cannot be restored. Your website’s IP address may also change. According to international cloud providers, if payment is not made on time, the service data will not be recoverable.

Obligations Under the Contract:

1.The client bears full responsibility for all scripts, images, videos, and any other content. If any null or cracked scripts that interfere with our system and harm others are found, or if fraudulent activities are detected, the account will be closed, and an investigation will be conducted. It will be permanently closed. The client will be assisted with the matter.

2. Only legal script content must be used, and the following content must not be uploaded: offensive, abusive, obscene, defamatory, or intimidating material. The rules of the server location, such as Singapore or the USA, must be adhered to, along with the rules of the server owner and the Internet Service Provider (ISP) of that server. It is solely the user’s responsibility to ensure compliance with these laws. The storage, distribution, or transmission of illegal materials may result in an investigation by relevant authorities and possible prosecution. Specifically, you should not gain or attempt to gain unauthorized access to any computer system for any purpose. Such actions may result in criminal charges under the Computer Misuse Act. You must not send data over the Internet using forged addresses or scripts that are intentionally designed to impact remote devices (such as DDoS attacks, worms, viruses, Trojans, and ping storms). You must ensure that your local PC and network-connected server do not act as open relays or send bulk email messages. This is considered spam. Running software like port scanning to test, verify, or access vulnerabilities in remote systems or networks is prohibited unless the remote user has explicitly granted permission. We may request proof of such permission.

  • Your login information, such as your password and username, must be kept confidential. Avoid sending or receiving illegal items like copyrighted content or hacking tools. If you have doubts about the legality of your actions or someone proposes such actions to you, you must seek legal advice. Under no circumstances is proxy server setup permitted, and doing so will result in the immediate termination of services. Sites should not contain ‘hateful’ content or elements designed to incite hatred. Sites should not display pornography or illegal images, videos, or illustrations that are considered objectionable at our discretion.
  • Sites must not contain copyrighted music/videos or links to such content. It is the user’s responsibility to ensure they have the right to distribute any content displayed on their website. Sites must comply with recognized international copyright laws.

3. Domain Name Registration: You are responsible for directly or indirectly registering a domain name and ensuring its use complies with the law. You must agree to ICANN services and never use a domain for illegal purposes. When transferring or selling a registered domain to another person, you must ensure and prove that the buyer agrees to and accepts the terms of this agreement in writing. We will not transfer domain ownership until all fees related to the associated services are paid. We have the right to place a hold on a domain if we receive any trademark/brand infringement complaints. We will act accordingly if a domain dispute resolution or settlement agreement is reached between the involved parties. Even in such cases, the renewal fee must be paid at the renewal date. We will hold the domain and not release it until the dispute is resolved and we are satisfied with the provided documentation.

Acceptable Email Use:

Emails are sent using SMTP, which is designed for everyday communication needs. All outbound mail is scanned by a cloud-based spam filtering system. We have a zero-tolerance policy against spam, and sending bulk, unsolicited emails is strictly prohibited at all times. Customers who misuse email services will be informed that their behavior is unacceptable, and their accounts may be suspended, closed, or blocked.

By purchasing services, you agree to the following policies:
  • Do not send emails that may cause annoyance, inconvenience, or anxiety to the recipient.
  • Do not send any emails that are offensive, obscene, threatening, or illegal in any way or that may cause distress.
  • Ensure that all newsletter communications have a clear policy.
  • Do not use our mail services or network to send bulk (commonly referred to as ‘spam’) or unsolicited individual emails.

  • Do not use our mail services or network to deny others service (‘mail bombing’).

  • Do not use false mail headers or alter mail message headers in a way that conceals the sender’s identity.

  • Do not use any email address you are not authorized to use.

  • Ensure that any email servers connected to our network and managed by you are not configured as open relays.

Responsibility for Your Own Email:

You are fully responsible for your own email. You must not take any action that violates your or our obligations under the General Data Protection Regulation (GDPR) or the Data Protection Act 2018.

Refund for Prepaid Month:

We offer low-cost services with significant discounts for pre-payment. If you cancel your service before its end date, and the service was faulty or misdescribed, you may have the legal right to terminate your contract, have the service re-performed, or receive some or all of your money back. You must inform us in writing with reasons for why the service was faulty or misdescribed. We will respond to any complaint within 7 days of receipt and notify you whether a refund will be issued.

Change of Mind:

If you change your mind about the product, we offer a “7-Day Money Back Guarantee.” You must notify us within 7 days of opening your FevHost hosting account that you wish to cancel. The 7-Day Money Back Guarantee is only applicable for 12-month subscriptions. This means that if you purchase a hosting package for a year and, for any reason, our service is interrupted or you are not satisfied with the service, you may cancel the entire subscription within 7 days and receive a full refund. However, a valid reason must be provided for canceling the hosting service. Domain registration fees are non-refundable. This guarantee does not apply to dedicated servers, domain name registrations, renewals, or transfers.

Inappropriate or Illegal Activities:

If any illegal activity, such as unauthorized files, pirated software, hacker programs, warez programs, or other illegal content, is found in your account, it will be immediately suspended. Failure to remove inappropriate content will result in account termination. In such cases, no money-back guarantee or refund will be given.

Refund Processing:

Refunds will be processed within 7 working days of receiving the money-back request. No refunds will be issued after 7 days.

Cases Where Refunds Will Not Be Issued:

  • If any of our terms are violated.
  • For offer packages.
  • For hosting gambling/investment sites or content.
  • For hosting any 18+ adult sites or content.
  • If any support member is insulted or treated poorly.
  • If there is an attempt to register a gambling/18+ obscene domain name.

 

Right to Change Your Mind:

You have the right to change your mind, but it must be within 7 days. You have the legal right to change your mind and receive a refund within 7 days.

How to End the Contract with Us (If You Change Your Mind):

If you want to end the contract, please notify us. To end the contract with us, log in to the HostSR Hosting BB client area, then go to services and submit a cancellation request or open a support ticket. Fill out the reason for cancellation. If you are eligible for a refund under the money-back guarantee, please state the cancellation clearly.

Our Rights to End the Contract:

We may terminate the contract if you breach the terms. We may write to you at any time to terminate the contract if:

  • You fail to make any payment due.
  • You do not provide necessary information within a reasonable time, when asked, for service delivery.
Where to Find Service Prices:

The service prices will be listed on the order page at the time of ordering. Where VAT is applicable (depending on your location and the services you order), it will be detailed in the order steps.

Price Changes:

We reserve the right to change the prices and fees advertised on our website at any time. We will provide written notice of any changes via email to the address you provided when registering your account. In most cases, price changes will be for new customers and will not affect existing customers. If your contract is for a specific term, price changes will take effect at the end of the current term and upon renewal.

When and How to Pay:

We accept payments through b-Kash, Rocket, Nagad, U-pay, and Cell-Fin.

When and how much you need to pay depends on the product and how long you are purchasing it for. 

Outstanding invoices will be sent to the email address provided during account registration. You will make payments using a legally authorized payment card. If you are not the cardholder and the cardholder or issuer rejects the transaction or requests a chargeback, you will compensate us for any damages.

Failure to Pay:

If you fail to make payment within 3 days of the due date, your service will be temporarily suspended. If payment is not made within 14 days, the service will be permanently terminated. If payment is made within those 14 days, the service will be reinstated without any interest or late fees. However, if the service is permanently terminated, all data will be deleted and cannot be recovered.

Incorrect or Double Invoicing:

If you believe you have received an incorrect or duplicate invoice, please contact us immediately.

Liability for Damage Caused by Us:

We are liable to you for any foreseeable damage caused by us. If we fail to comply with these terms, we are responsible for any damage caused by our breach of this service agreement. You have the right to request a full refund for your damages.
